Exterior:

  • Sidewalks and curbs: All sidewalks, driveways, parking spaces and stairways must be kept in good condition and maintained free from hazardous conditions.
  • Handrails: Every exterior and interior flight of stairs over 4 steps must have a handrail on one side of the stairs, landing, deck or ramp. Every handrail and guard must be firmly fastened and capable of supporting weight.
  • Foundation: All foundation walls must be maintained in good condition to prevent cracks, leaks, holes, etc.
  • Rubbish: Accumulation of garbage or rubbish is prohibited and shall be collected regularly. All rubbish shall be disposed of in a clean and sanitary manner in approved containers.
  • Broken windows: Windows, door and frame must be in good repair and structurally sound to exclude rain and wind from entering the building. Screens (16 mesh per inch) not torn or loose are located in all windows, doors and openings used for ventilation during warmer months. Every swinging door shall have a self-closing device in good working condition. Screens not required where other approved means (i.e., curtains, insect repellent fans) are used.
  • Peeling paint: Exterior is free of peeling paint and penetrations.
  • House numbers: Buildings must have approved address numbers placed where they are plainly legible and visible from the street. Numbers must in Arabic numerals and at least 4 inches tall and minimum width of 0.5.
  • Roof: Must be structurally sound, tight and have no defects to cause water dampness in the walls or interior portion of the building.
  • Sheds: Accessory structures and sheds shall not exceed 150 square feet in size. Structure shall be maintained to be structurally sound and in good repair. Structure shall be at least five feet from property lines. No accessory structure may be located in a front yard. Accessory Structure/Shed Permit required at the cost of $30.00.
  • High grass and weeds: Grass and weeds cannot exceed a height of six inches unless it is used for the purpose of edible and/or ornamental vegetation or unless in areas that remain undeveloped and historically have contained dense foliage.
  • GFCI: GFCI outlets within 6 feet of water including exterior, unfinished basement, garage, kitchens, bathrooms, laundry, tub area, etc.
  • Pools: Outdoor pools capable of holding 24 inches in depth or more must be completely surrounded by a fence that is at least 48 inches in height. Gates and doors for the fence must be self-closing and self-latching. Release mechanism must be at least 54 inches above the bottom of the gate; otherwise special requirements apply. Spas/Hot Tubs: May be exempt is they have a safety cover that complies with ASTM F 1346 (American Society of Testing and Materials). Borough regulations state Swimming Pool permit shall be obtained prior to construction of a pool at the cost of $100.00 for in-ground pools and $25.00 for above-ground pools. Fences are required around pools.
  • Exterior stairs: Stairways, decks, porches and balconies must be structurally sound. Stairways, fire escapes and other means of exiting a building must remain clear and unobstructed.
  • Chimneys/Towers: All chimneys and towers must be in good repair and structurally safe. Where applicable, exposed surfaces must be protected against decay and rust.
  • Extermination: The owner of any building must be responsible for extermination of a structure including common/shared areas. However, an occupant is responsible for extermination of a dwelling unit when the infestation exists only in the one unit. Multiple units infested is the owner's responsibility for extermination.
  • Overhang Extensions: Overhang extensions (canopies, signs, awnings, etc.) must be in good repair and properly anchored. Where applicable, the overhangs must be protected against decay and rust.
  • Fences/Walls (Exterior): Must be free of holes, breaks, loose or rotting boards/timbers. Exterior paint and/or siding must be kept in good repair. Located in rear yard, fence shall not exceed six feet in height. Located in front yard, fence shall not exceed three and a half feet in height. No fence shall be constructed of barbed wire, metal spikes, or other dangerous material in any residential district. Fence permit is required for any fence installation over three feet in height at a cost of $40.00.

Interior:

  • Smoke alarm: Owners are responsible for providing a functioning smoke detector in the immediate vicinity of as well as in the rooms used for sleeping. Additional stories of a dwelling which includes basements quarters must have smoke alarms installed. Excluded are crawl spaces and uninhabitable attics.
  • Handrails: Every exterior and interior flight of stairs over 4 steps must have a handrail on one side of the stairs, landing, deck or ramp. Every handrail and guard must be firmly fastened and capable of supporting weight.
  • Sprinkler system: In accordance with National Fire Protection Association (NFPA 25).
  • Heating systems: Dwellings shall be provided with heating facilities capable of maintaining 68° F. (20° C.) in all habitable rooms. Cooking appliances shall not be used to fulfill this requirement. Water heater is not leaking and has a pressure relief valve and discharge tube.
  • Water supply: Public.
  • Fire extinguisher:  Required in all rental properties.
  • Safe stairs: Must be capable of supporting the normal use load and shall be kept in good repair and condition.
  • GFCIs: Every new bathroom receptacle shall have at least one GFCI installed. Laundry room/area must have a grounded-type receptacle or GFCI.
  • Exit Doors: AAll properties must provide for a safe and continuous path from any point in the building to a public street. Basement sleeping rooms must have at least one operable window or exterior door. These windows or doors must have devices that secure the unit. Doors must be able to open and close easily and are weather tight. Cellar doors must be able to be opened from the inside, accessible to emergency personnel, prevent rodent and water access.
  • Sewer: Public.
  • Walls: No flaking or peeling paint. No cracked or loose plaster
  • Windows: Every habitable space must have at least one window that is of adequate size facing directly outdoors or to a court. Windows must be able to be opened and stay opened as well as the ability to be locked/secured.
  • Appliances: Dryer must be vented to the exterior of the structure.
  • Exhaust Fans: Is operational in bathrooms or a window is able to be opened.
  • Plumbing: All plumbing and fixtures must be free of leaks. All sinks, bathtubs and showers must supply hot or tempered and cold running water in accordance with the International Plumbing Code. Toilets must be able to flush and have a shut-off valve. Sinks have traps and a shut-off valve.

  • Sewer Certification §134-32 - Obtained through the Borough; Required upon the sale or transfer of property to certify no illegal connections or leaking, deteriorating or poorly constructed private sanitary lateral and/or connections, inflow or surface, drainage, storm or ground water is associated with the property. 
    • Application must be maid at least 21 days prior to the date of sale or transfer of property. 
    • The applicant shall schedule a licensed plumber who is registered with the Borough to perform a dye test of the drainage system.
    • The licensed plumber who performed the dye test shall complete the application confirming the results. 
    • If no illegal storm or surface water connections are found and the drainage system is proven sound, the Borough Secretary shall issue a Sanitary Sewer Certification upon the payment of a $25.00 fee. 
    • Temporary Sanitary Sewer Certification - If repair and/or corrections cannot immediately be done due to weather or hardship to the applicant, the owner may apply for this type of certification. A written contract between the applicant and plumber, a cash security, and an agreement by the purchaser to be responsible for all cost overruns must be submitted to the Borough. The temporary certificate shall expire within 30 days of its issuance. 
  • Building Permit §168-600 -  Required for new additions, structural alterations, decks, complete roof replacement, and new construction.; Obtained through the Borough. Permit valid for six months if construction has not begun and five years once construction has begun.

Sign Ordinances and Solicitation Rules

For Sale/Sold Signs:
  • Real Estate Signs - Signs advertising the sale or lease of property.
    • Sign may not exceed 12 square feet in size.
    • Sign must be located on the property which it advertises is for sale or lease. 
    • No sign shall be located within the public right of way. 
    • Sign permit not required for signs adhering to these regulations. 
  • Yard/Garage Sale Signs - 
    • Limit two sales per calendar year.
    • Goods for sale must be removed from premises immediately upon end of sale.
    • Sale shall not exceed two days in duration.
Solicitation Rules:

Peddling and Soliciting Ordinance §127 - 

No person shall engage in soliciting or peddling in the Borough of Baldwin without first registering activity through the Borough and obtaining a permit for such activity. However, exemptions apply to the following:

  • Minors under the age 18 engaging in soliciting or peddling on behalf of a non-profit, school, or governmental organization.
  • Persons soliciting on behalf of a non-profit or neighborhood organization for donations or membership to such organization. 
  • Farmers seeking or taking orders for the sale of their own products. 
  • The seeking or taking orders by any manufacturer or producer for the sale of bread and bakery products, meats and meat products, milk or milk products if sold in a sole location.
  • The seeking and taking of orders by insurance agents or brokers, or stock brokers or banking brokers, licensed under the insurance laws of the Commonwealth of Pennsylvania for insurance. 
Permit Requirements/Fee:

Peddling and Solicitation Regulations §127 - 

  • Permit fees are as follows: 
    • License fee: $25.00/month
    • Subsequent fees: $15.00/week, $50/month, $75/three-month period
  • No licensed solicitor or peddler shall engage in soliciting or peddling before 9:00 a.m. or after dusk, Monday through Saturday, nor on Sunday or legal holidays.
  • Any licensed solicitor or peddler shall carry identification card and shall display card to residents or police when requested. Identification card shall be obtained from the Chief of Police. 
  • No licensed solicitor or peddler shall shout, cry out,  ring a bell, blow a horn, or use any other sounding device. 
  • No licensed solicitor or peddler shall have exclusive right to any location. 

Building Codes and Zoning

Building Code Requirements:
  • Baldwin Borough has adopted The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401–405, which is amended from time to time, as the municipal building code of this Municipality as cited in Ordinance §1285. A Board of Appeals has been established by a resolution by Baldwin Borough Supervisors.
  • Borough of Avalon has adopted the 2009 Edition of the International Property Maintenance Code (IPMC) as a system and standard to maintain safety in all properties within the Borough as cited in Ordinance §1332.
Property Maintenance Requirements/Code Enforcement:
  • Cats §82 - 
    • Cats must be current on rabies vaccination. (Exception: If a cat in unable to be vaccinated due to a physical condition, owner may waive rabies vaccine for a veterinarian's certificate.)
    • It is unlawful to keep more than four cats in any residential housing unit or property.
    • Cats over the age of seven months must be licensed for a fee of $5.00, which shall be valid for a maximum of one year. 
    • It is unlawful to allow a cat to be a noise disturbance, vicious, or run at large.
    • It is unlawful to allow a cat to dig, scratch, or defecate upon public or private property not owned by the owner of the animal. 
    • It is unlawful to harbor a cat that is not domesticated. 
    • It is unlawful to abandon any cat or allow a cat to become a stray. 
    • Area where a cat is sheltered must be maintained to be clean and sanitary.
    • it is unlawful to harbor or feed any unlicensed or stray cat. 
  • Dogs §85 - 
    • Dogs must be current on rabies vaccination with a veterinarian's certificate stating such.
    • Dogs over the age of six months must be licensed for a fee of $5.00 between January 1 and February 28. Dog tag shall be attached to dog's collar or harness at all times. 
    • It is unlawful to allow a dog to frequently and habitually bark, howl, screech, yelp, or bay in any manner which creates a nuisance. 
    • It is unlawful to allow a dog to dig, scratch, or defecate upon public or private property not owned by the owner of the animal.
    • It is unlawful to keep more than four household pets over the age of six months on any premises. 
  • Burning §81 - 
    • Fire shall be at least 15 feet from nearest property line. 
    • Fires shall be attended at all times by adult 18 years of age or older.
    • Only clean, dry wood shall be burned in recreational fire. 
    • Fire shall be contained in an outdoor fireplace, fire pit, chimney, or 50 gallon drum. 
    • The person(s) maintaining the fire shall be responsible for all fire-suppression costs and other liability from damage caused by the fire. 
    • It is unlawful to burn refuse such as waste material, building supplies, garbage, grass, or leaves. 
  • Vehicles §157 - 
    • Prohibited vehicle conditions: invalid registration plate, invalid inspection certificate, invalid identification number, incapability of moving under its own power, has not been moved for more than seven consecutive days, or if the vehicle bears a current license plate and current inspection sticker but has not moved for 30 consecutive days. 
    • No person shall abandon a vehicle upon any private or public grounds.

  • Security: Doors providing access to the dwelling unit must be equipped with a deadbolt lock. Manufacture specifications for installation must be followed as well as maintenance to ensure deadbolt is operable. Sliding bot is not considered an acceptable deadlock. Windows operable within six feet above ground level must be equipped with a window sash locking device.

  • Cooking is not permitted in a rooming or dormitory unit unless approved through an application for Certificate of Occupancy through the Borough. Coffee pots and microwaves are excluded as a cooking appliance.
